We grant the petitions in part and remand to the
Commission. The Commission failed to provide a reasoned
explanation for its determination that its guidelines adequately
protect against the harmful effects of exposure to
radiofrequency radiation unrelated to cancer.

בית המשפט כתב כי הFCC אינו יכול לבסס את המדיניות שלו, או להצדיק אותה בהתבסס על קביעה ללא הצדקה, הסברים או הנמקה של הFDA. האמרה הזו מכוונת למסמך קצר של FDA אשר הוגש לבית המשפט על ידי ה FCC, כהצדקה ונימוק להגיון מאחורי התקן הגבוהה והלא מגן שלהם. המסמך כלל מסר ברור וקצר "לא מזיק חוץ מחימום" אבל ללא כל הצדקה , ללא מחקרים, ללא ביקורת על מחקרים שמראים נזקים וללא כל הנמקה. בית המשפט כתב בנוגע לכך, (בתרגום קל לעברית): שניים ששוגים אינם הופכים לצודק.

במסגרת התביעה הוגשו לבית המשפט יותר מ200 עדויות של אנשים אשר חוו פגיעות ופציעות ממחלת קרינה (!!!). הFCC התעלם גם מעדויות אלו במשך כל הטיפול בתיק.

עו"ד דפנה טחובר שעובדת על התביעה מטעם ה CHILDREN HEALTH DEFENCE , כתבה הצהרה קצרה בפייסבוק לאחר פרסום הפסיקה. להלן תרגום שלי לעברית: "התקנים של ה FCC לגבי דור חמש לא מבוססים על עובדות. ניצחנו בתביעה שלנו נגד הFCC! בית המשפט קבע שהחלטת הFCC לא לבצע שינוי בתקנים לדור חמש ולקרינה אלחוטית (קרינת רדיו-מיקרוגל), משום שאין לדעתם הוכחה לנזק , איננה מבוססת על עובדות. הFCC התעלם מהעובדות לנזקים בריאותיים שלא קשורים לסרטן. נעשתה היסטוריה. הלוואי והייתי זבוב על קירות התעשייה עכשיו. נתתי שנה שלמה מחיי בשביל התיק הזה. כל כך שמחה!".

ד"ר דברה דוויס , ראש ה EHT אמרה כי "אם טלפונים סלולרים היו תרופה, הם מזמן היו נאסרים לשימוש. דור חמש בסלולרי לא היה מותר לשימוש. גוף מחקר הולך וגדל, המראה בבירור כי חשיפה לקרינה אלחוטית (קרינת רדיו-מיקרוגל) יכולה להביא להשפעות בריאותיות רבות – במיוחד אצל ילדים, זוכה להתעלמות מהFCC. מחקר מראה כי קרינת רדיו מעלה את הסיכון לסרטן, פוגעת בזיכרון, משנה את התפתחות המוח, פוגעת במערכת הרבייה, ועוד. כמו כן הדרך בה הFCC מודד את החשיפה היום יומית לקרינה ממכשירי הסלולר ואנטנות סלולריות היא שגויה מהיסוד ומספקת תחושת ביטחון שגויה"

If cell phones were a drug they would have been banned years ago.  5G would never have been allowed to market. An ever mounting body of published studies – ignored by the FCC- clearly indicates that exposure to wireless radiation can lead to numerous health effects, especially for children. Research indicates wireless radiation increases cancer risk, damages memory, alters brain development, impacts reproductive health and much more. Furthermore, the way the FCC measures our daily exposure to cell phone and cell tower radiation is fatally flawed and  provides a false sense of security

Environmental Health Trust submitted hundreds of pages of scientific evidence to the FCC over the last several years documenting the scientific data showing harm, the need for health agencies to create safety limits that protect against biological effects and the urgency for infrastructure policy that prioritizes wired rather wireless communications to reduce public exposure.

“Where do we go from here? We need a congressional hearing into how this agency operated above the law to ensure it never happens again.

There was no premarket safety testing for cell phones or wireless networks before they came on the market decades ago. As the court points out in the ruling, silence from federal health and environmental agencies does ‘not constitute a reasoned explanation for the Commission’s decision.’

This ruling highlights how there has been no scientific review of the full body of scientific research to ensure people and the environment are protected.

A telecom financed scientist drafted webpages to be put online by our federal government. When people try and stop a cell tower from being built in front of their homes, they are told by their elected decision that they cannot consider the issue of health effects due to the Telecommunications Act  of 1996. This has to stop.

The U.S. Government Accountability Office in 2013 asked the Federal Communications Commission to reassess their public radiation exposure limits given science was showing potential harm.

The FCC opened Docket 13-84 into which thousands of pages of testimony were submitted by expert scientists, doctors, the American Academy of Pediatrics, the American Academy of Environmental Medicine, citizens and other organizations documenting great biological harm to both people and planet.
